The facts underlying the decision of Cooke J in International Management Group (UK) Ltd v Simmonds [2003] EWHC 177 (Comm), [2004] Lloyd’s Rep IR (forthcoming) are primarily of interest to lovers of cricket, although the decision itself does contain some useful comments on the coverage of cancellation policies and warranties relating to permits required by the assured. There is also some discussion of the materiality of rumours and inducement in the law of utmost good faith, and confirmation that the following market should be in no worse a position than the leading underwriter.
