The limits of Owusu: exclusive jurisdiction clauses

In Konkola Copper Mines plc v Coromin [2005] EWHC 898 (Comm), forthcoming in [2005] Lloyd’s Rep IR, Colman J has imposed a significant limitation on the Owusu principle, by holding that it has no application to exclusive jurisdiction clauses. Konkola is also of importance on the question of the incorporation of exclusive jurisdiction clauses into reinsurance agreements.
