Medical report considered unreliable in immigration case
SA (Somalia) v Secretary of State for the Home Department [2006] EWCA Civ 1302
Counsel: For the appellant: Sonali Naik For the respondent: Charles Bourne Solicitors: For the appellant: Dare Emmanuel For the respondent: Treasury Solicitor
S appealed against the refusal of his claim for asylum and the decision of the Secretary of state that he should be removed
from the UK. S was a Somali national, and he stated in his asylum application that he had suffered persecution in his own
country. He presented the adjudicator with a medical report supporting his claim but the adjudicator did not believe his version
of what had happened, and dismissed the claim on the ground that it lacked credibility. The Asylum and Immigration Tribunal
dismissed an appeal by S, as it took the view that the medical evidence did not corroborate his case.
