Fraud in personal injury claims

Calderdale & Huddersfield NHS Foundation Trust v Atwal [2018] EWHC 961 (QB)

Exaggerated symptoms - Allegations of contempt of court are becoming more common in personal injury claims when fraud on the part of the claimant can be established. This includes the situation in which an individual fraudulently exaggerates the effect of minor injuries, as in this case. The court is required to consider the admissibility of the individual’s contemporaneous medical records as proof of the truth of their contents.
