Appeal involving ex turpi causa

Wallett v Vickers [2018] EWHC 3088 (QB)

On appeal, the High Court has found that a recorder had been wrong to find that a driver who had died in a car crash while speeding on a dual carriageway had been engaged in a criminal joint enterprise of dangerous driving with the driver of another car, barring a claim for damages by the deceased’s partner on the grounds of ex turpi causa. The High Court ruled that the claim should be decided on the normal principles of causation and contributory negligence.
