VERSLOOT AND THE INSURANCE ACT 2015
Jack Alexander* and Daniel Brinkman*
The DC Merwestone
Insureds often resort to a number of mechanisms to obtain payment from insurers. The remedial response depends on the nature of the mechanism used. On one hand, the claim may be exaggerated or wholly fabricated. On the other, there may be a valid claim but, in an attempt to bolster it, the insured may make a false statement which is ultimately irrelevant to the claim’s merits. The latter is commonly known as a fraudulent device.
