Courts may need to rule on scope of cryptoassets regulation

The FCA has hinted that litigationmay be needed to decide where the regulatory perimeter lies regarding cryptoassets. In its finalised Guidance on Cryptoassets the regulator says that the issue is “a matter for legislation and the courts”, and that it can “only provide guidance on how we believe the current perimeter applies to cryptoassets”.
