King v Brandywine Reinsurance Co [2005] EWCA Civ 235

This is a sequel to the article appearing in Shipping & Trade Law (Volume 4: November (pp 1–3). On 10 March 2005 the Court of Appeal upheld the judgment of Colman J. It differed only in its finding that New York rather than English law applied. However, that would have made no difference to the final outcome because, the Court of Appeal considered, a New York court would have taken the same view on critical matters of construction.
