‘Laycan’ in sale of goods contracts

Two recent cases have dealt with the reference to ‘laycan’, not where it is natively found (in a charterparty) but in a sale of goods contract. These cases are, first, SHV Gas Supply & Trading SAS v Naftomar Shipping & Trading Co Ltd Inc [2005] EWHC 2528 (Comm) (see Shipping and Trade Law (Volume 5: December (pp 6–8)), and, second, ERG Raffinerie Mediterranee SpA v Chevron USA Inc [2006] EWHC 1322 (Comm), which was decided on 9 June 2006.
