Guidelines issued by professional bodies and organisations such as NICE (the National Institute for Health and Clinical Excellence) are frequently referred to in litigation, and there are varying attitudes towards their status. In the case outlined here, Mrs Justice Lambert, a judge of High Court, took the view that NICE Guidelines concerning the use of electronic foetal monitoring were not intended as a complete compendium of clinical definitions or management options.
