Arbitration – Award – Enforcement – Consent award providing for payment of sums by defendant – Claimant applying to enforce award pursuant to section 66 of the Arbitration Act 1996 – Defendant raising issues of construction of award and relying on variation and estoppel arguments – Court making determinations of fact and law – Whether claimant entitled to enforce award

By a settlement agreement in writing dated 30 November 2018 (the Settlement Agreement) the claimant and the defendant compromised a dispute that had been referred to LCIA arbitration. The Settlement Agreement provided that the parties should compromise the arbitration by way of a Consent Award.
