One of the key verdictsthis year was that of the Court of Justice of the European Union’s(CJEU)decision between Brompton Bicycle Ltd v Chedech/Get2Get, 1in the context of folding bicycles. The decision reiterated that in the contextof functional designs, copyright may also subsist where the work (design)maintained originality – specifically in that it is the author’s ownintellectual creation; and that the author’s creation is expressed.
