Disputes under two contracts referred to same adjudication

In Delta Fabrication & Glazing Ltd v Watkin Jones & Son Ltd [2021] EWHC 1034 (TCC) Her Honour Judge Sarah Watson held that the claimant was not entitled to summary judgment in order to enforce the decision of an adjudicator. She found that the defendant had a strong prospect of successfully defending the claim on the ground that the adjudicator lacked jurisdiction because the claimant had referred disputes under two separate contracts to the adjudicator in one referral. The claimant’s case that the two contracts had been amalgamated into one contract was not supported by the evidence before the court.
