Scottish costs rules overhaul risks encouraging spurious claims

June 30, 2021 was a landmark day for Scotland’s injury claims, as qualified one-way costs shifting (QOCS) went live. Now any person raising a court action for personal injury compensation will no longer be liable to pay the other side’s legal costs, even if they lose the case, unless they fall into any of the QOCS exceptions.
