Dispute relating to non-payment of three invoices held to be a single dispute

In Quadro Services Ltd v Creagh Concrete Products Ltd [2021] EWHC 2637 (TCC) Her Honour Judge Sarah Watson granted summary judgment in order to enforce the decision of an adjudicator and rejected the defendant’s submission that the adjudicator lacked jurisdiction because three disputes had been referred to him in a single adjudication. Although the dispute related to the non-payment of three invoices it was held that they were all part of the same dispute in that they all related to the same project and each invoice built upon the sum claimed in the previous invoice. The three invoices were held to be sub-issues in a single dispute relating to the amount due to the claimant under its contract with the defendant.
