When a ‘hopeless appeal’ should go ahead

Even where an appeal appeared hopeless and bound to fail, it was not appropriate for the court of appeal to set aside permission to appeal where the area of law in question was one of considerable controversy. In this case the issue was a claim of unfair dismissal due to trade union activity.
