MUR Shipping BV v RTI Ltd [2022] EWCA Civ 1406

When uncertainty is not enough

Contrary to the approach in K Line Pte Ltd v Priminds Shipping (HK) Co Ltd ( The Eternal Bliss) [2022] 1 Lloyd's Rep 12 of playing the trump card of certainty in commercial matters, the majority of the Court of Appeal in MUR Shipping BV v RTI Ltdhave adopted an antithetical approach to interpretating force majeure clauses.
