Council liable for tree root damage

The owner of a property was entitled to recover for damage caused by the incursion of tree roots from an adjoining highway. In the case at issue, this was despite the damage having been caused before the owner’s purchase of the property and there being no new damage after that date as, in declining to remove the tree, the highway authority had continued the nuisance.
