VINCI CONSTRUCTION UK LTD v EASTWOOD AND PARTNERS (CONSULTING ENGINEERS) LTD, SNOWDEN SEAMLESS FLOORS LTD AND GHW CONSULTING ENGINEERS LTD

Limitation – Date of accrual of cause of action – Date of knowledge that damage was attributable to negligence

In the present action, the third party, GHW Consulting Engineers Ltd ("GHW"), applied for reverse summary judgment against the second defendant, Snowden Seamless Floors Ltd ("Snowden"), on the ground that Snowden had no real prospect of succeeding in its claim against GHW because the claim was time-barred as a result of the expiry of the relevant limitation period. GHW also sought to strike out Snowden's claim for contribution pursuant to the Civil Liability (Contribution) Act 1978 on the ground that it disclosed no valid cause of action against GHW.
