Adjudication – Stay of execution – Parent company guarantee – Indemnity costs

The claimant sought to enforce the decision of an adjudicator in which the adjudicator decided that the defendant must pay to the claimant the sum of £3,316,487.55. While the defendant accepted that the claimant was entitled to summary judgment to enforce the decision of the adjudicator, it sought a stay of execution pending the outcome of the true value adjudication on the ground that the claimant was insolvent and that the guarantee provided by its parent company was inadequate to safeguard the position of the defendant.
