Jennings v Otis Ltd and Another [2023] EWHC 2039 (KB)

It can be extremely difficult to establish the facts surrounding an accident when the accident victim has no recollection of the event and there are no independent witnesses. The claimant submitted that he would be prejudiced by the Case Management Order which required a further reply to the Pt 18 request and unilateral service of the Claimant's witness evidence. The importance of acting in accordance with the overriding objective highlights that even in a high-value claim, the substance of the case should be plain and clear to allow early identification of issues concerning liability.
