National Fund in the Court of Appeal
Cy-près schemes and the Charities Act 2011
Francis Ng
The Court of Appeal recently handed down judgment in
Zedra Fiduciary Services (UK) Ltd v Attorney General [2023] EWCA Civ 1332, dismissing Zedra's appeal against the cy-près scheme directed by Zacaroli J in
Zedra Fiduciary Services Ltd v Attorney General (No 2) [2022] EWHC 102 (Ch). This is the first Court of Appeal decision concerning the power to direct a cy-près scheme since the
enactment of what is now section 67 of the Charities Act 2011 ("CA 2011"). It therefore bears careful reading by those practising
in the charities field.
