Re Mattingley is a relatively recent decision of the High Court concerning an alleged secret trust. HHJ Davis-White QC (as he then was) also makes some instructive remarks in his judgment in relation to the preparation of trial bundles and the way in which a court will assess the oral evidence of witnesses. It is therefore useful to revisit the judgment.
