Multiple insurance does not invalidate personal injury claim

The existence of multiple contracts of insurance covering the same interest did not preclude recovery under an accident and illness policy for the injury or death of a person on board a vessel. In considering such situation, it was only necessary for the court to consider whether the insurance interest was insured in a manner which could not fairly be characterised as gaming or wagering at the time of contract.
