Limitation proposals accepted

The Government has accepted, in principle, the recommendations of the Law Commission on time limits in civil claims. Currently the Limitation Act of 1980 applies different periods depending on the type of claim. Under the new proposals there would be a single limit of three years from the time when the claimant knew, or should have known, facts giving rise to the claim, with a longstop of ten years during which the claim must be commenced. Legislation will be introduced “when an opportunity arises”.
