This case is one of several which have come before the courts in recent years, but it is the first involving a claim of more than £6m, which had been reduced to more than £1m based on the honest aspects of the claim. The case of Shaw v Wilde is likely to be used as a reference point in future cases because the comparison drawn by the judge between the claimant and an individual with similar injuries caused by a non-solvent tortfeasor provides useful measures on the issue of substantial injustice.
