Proportionality in issuing costs warnings

A service station operator, representing herself, claimed unfair dismissal by Shell, represented by Andrew Hochhauser QC, before an employment tribunal. In the course of the hearing and after representations by Mr Hochhauser the chairman of the tribunal warned the claimant that she was at real risk of a substantial costs order if unsuccessful. Fearful of losing her home, she withdrew her claim.
