Costs after acceptance of payment-in

Where a claimant had accepted a payment into court, more advantageous than a Part 36 offer which he had rejected, as settlement, a court had no discretion to award indemnity costs. Further, in absence of hearing to assess the quantum of damages the court could not rule on the reasonableness of rejection of the Part 36 offer. The claimant was entitled to standard basis costs only.
