Cost order in favour of non-party

A court has jurisdiction under section 51 of the Supreme Court Act 1981 and rule 48.2 of the Civil Procedure Rules to make a costs order in favour of a non-party to the litigation. In this case a claimant issued a witness summons against an employee of the bank applying for costs.
