The Volpi saga provides welcome clarity on jurisdictional limits

On 28 December 2023, Justice Loren Klein of the Supreme Court of The Bahamas ("the Court") handed down a consolidated judgment in the seemingly interminable and increasingly renowned case of Gabriele Volpi v Delanson Services Ltd & 2 Others and Delanson Services Ltd v Matteo Volpi and 2 Others ("the Proceedings"). The decision serves to provide important clarification as to the jurisdictional limits of the court in relation to arbitral awards generally. It also establishes the continued prominence of The Bahamas for the arbitration of trust disputes and highlights the robust nature of its supporting legislation.
