O v C [2024] EWHC 2838 (Comm)

A fanciful risk of prosecution for breach of sanctions

This dispute involved an arbitration claim pursuant to section 44 of the Arbitration Act 1996 concerning the sale of a naphtha cargo affected by US sanctions. The UK Commercial Court ordered payment of proceeds of sale of cargo into court notwithstanding the potential risk of breaching US sanctions.
