Sale of cargo - Effect of lien - Arbitration Act 1996, section 44

On 12 April 2024 a voyage charterparty was entered into in respect of the vessel Lord Hassan between Lord Marine (owners) and Vimeksim (charterers). The charterparty consisted of a recap and Synacomex 2000 standard terms. It stated: "Freight to be paid by Charterers 100[%] less commission in USD currency ...". Clause 21, the lien clause provided that: "The Owners shall have a lien on the cargo for freight, deadfreight, demurrage and average contribution due to them under this Charter Party".
