Measure of indemnity in insurance

Although this insurance dispute arises under a construction all risks policy, Popplewell LJ applied the relevant rule in marine insurance that damage occurring after the policy period as a result of a peril occurring during the policy period is recoverable provided there is no intervening cause. It also clarified key issues on "damage" definition, loss continued after the period of insurance ends, and deductible aggregation. The reasoning of the decision is equally informative to marine insurance lawyers.
