Although many NHS staff are constantly concerned about the question of access to records and patients' confidentiality a recent case illustrates that under the UK GDPR and the Data Protection Act 2018, the right to erasure is not absolute. In some circumstances, it is not appropriate to delete data, and courts can be reluctant to allow individuals to litigate on matters that have previously been resolved.
