Dobson v Chief Constable of Leicestershire Police [2025] EWHC 272 (KB)

The police are experienced in dealing with people who have mental health problems and guidance is available to direct them about how to deal with people in custody experiencing mental health difficulties. A claim for negligence against the police failed in a recent case in which the claimant argued that he should have been detained in custody for longer for a full mental health assessment to be carried out. The judge made an important point about the preferred expert witness, who was the one who had developed the most experience in the area of practice under consideration.
