Costs in removal applications

Hanson v Coleman [2025] EWHC 116 (Ch)

Too often, parties to removal proceedings set off on the footing that whatever the outcome, the estate will foot the bill. That is perhaps especially the case for defendant executors, who may assume that the costs of litigation are simply to be added to the various expenses already incurred in the administration of the estate. It is therefore imperative that parties are reminded of the likely cost consequences of resisting a removal application at the earliest opportunity.
