Limitation of liability and cause of action estoppel

In this case, Cockerill J affirmed that the right to limit under the Convention on Limitation of Liability for Maritime Claims 1976/1996 (LLMC) is a substantive one for the purposes of cause of action estoppel. The judge also held that limitation under LLMC was res judicata as a result of an earlier order of the Court of Appeal.
