No imposition of a non-delegable duty

The Court of Appeal ruled that there was no justification for imposing a non-delegable duty on the MoD to ensure that due skill and care was exercised in German hospitals in circumstances where the MoD was no longer in the business of treating patients in hospital in Germany and its sole role was that of arranging for such treatment to be provided by others.
