Overseas absence of lead defendant no bar to writ service

On 12 October, the House of Lords supported the Court of Appeal finding that defendants resident in a country that had signed the Lugano Convention could be sued in the courts of a another country where a co-defendant was being sued despite the fact that he had left that other state by the time the writ was served against them.
