A balancing act – the year in view
This year has seen a number of important decisions, writes Charlotte Digby of Eversheds, which will affect how many civil fraud cases are handled in the future. The cases generally seem to have at their core the courts’ desire to act in the wider public interest. Despite the courts’ continued willingness to assist the victims of fraud, they will not do so at the expense of the wider financial services community.

Freezing Orders - House of Lords’ decision brings relief to banks
One of the most notable decisions was that of the House of Lords in June in
Commissioner of Customs and Excise v Barclays Bank
[2006] UKHL 28. It was good news for banks and other financial institutions which are served with freezing orders.
