Investigating misdelivery

William Leung examines misdelivery under forged bills and misdelivery in the absence of original bills and exemption clauses.

IN a recent Hong Kong case (handled by the author of this article, for the plaintiff) Center Optical (Hong Kong) Ltd v Jardine Transport Services (China) Ltd and Pronto Cargo Corporation (Third Party) , [2001] Lloyd’s Rep. 678 the goods consisted of two consignments of optical frames and sunglasses. Both consignments were shipped from Shanghai to Miami in 1998.
