In Surefire Systems Ltd v Guardian ECL Ltd [2005] EWHC 1860 (TCC); [2005] BLR 534 Mr Justice Jackson considered the circumstances in which a court can give leave under s69 of the Arbitration Act 1996 in order to enable a party to challenge the validity of an arbitrator’s award. He stressed that the right of a party to challenge an award is strictly limited and stated that there was a need for the construction industry, and those advising it, to grasp this point.
