17.1 As its name suggests, DB11 is intended for use where the contractor is not only to carry out the physical work and supply of materials necessary to complete a building project but also to carry out the whole of the design. By section 2.17.1 the liability of the contractor as designer is limited to a “like liability to the Employer, whether under statute or otherwise, as would an architect or, as the case may be, other appropriate professional designer holding himself out as competent to take on work for such design who, acting independently under a separate contract with the Employer, has supplied such design for or in connection with works to be carried out and completed by a building contractor who is not the supplier of the design”.
