MARITIME FRAUD AND THE SALE CONTRACT

TYPES OF FRAUD IN THIS CHAPTER

3.001 This chapter is concerned almost exclusively with where a successful or unsuccessful attempt is made to induce the buyer to pay for goods which do not exist, or have been stolen, or are otherwise not of contractual description and quality. The types of activity chapter fall essentially into two categories, thefts of cargo and frauds involving the documentation. The thefts differ from what might loosely be described as the handbag-snatching variety of crime, in that there is usually a deception involved; the cargo is not snatched, but deception is used to give the criminals control over it. It is therefore a type of crime that is properly encompassed within the ambit of maritime fraud.
